I was convicted of Armed Robbery in 2002. I was sentenced to 44 years, 33 years of which comes courtesy of a gun enhancement. My Appeals Attorney raised good issues, but I lost my appeal, and my remedies are exhausted; however there were several issues I would have liked to have been brought up. For instance, I was given a gun powder residue test. During deliberations, the Jury asked for the results, they were told they were "inconclusive." When I asked how was that possible, my attorney told me, the detective said, "He felt he had enough evidence, so he never sent it in (to lab)."

I was convicted on purely circumstantial evidence; this was exculpatory evidence I was robbed of. Witnesses couldn't identify me; they actually said I was too short. My fingerprints weren't on the gun used for the robbery, which wasn't found on me. My alibi witness didn't show up because she was a drug addict, but she was never subpoenaed. Also there was substantial reason to believe the detective "planted" evidence, because of "near impossibility" that a micro-sized glass shard could remain lodged in jacket collar after a four-block sprint, multiple "fence hopping," going home, changing clothes, being arrested (on my front lawn), strip searched. Then, the next day, a detective pulls the jacket from the evidence bag and the shard falls out?! For these reasons (and more I couldn't fit), I believe an attorney who could meet the complicated standards of obtaining a "new" appeal (in California) could get my case overturned.

Also, I plead to the reader's humanity. I was 18 years old with no priors, nobody got hurt, but they put me in prison until I'm 60. Since I've been incarcerated, I've earned college units and have done much soul searching. I've matured and I deserve a second chance, please help me.
