In 1998, Mr. Shawn Jetter was convicted for the offense of Murder in El Paso County, Texas, (Cause No. 980D08155; 243rd District Court). He was always maintained his innocence as to any involvement in the case and continues to do so today. Months before he was arrested an unknown person called the El Paso Police Dept., falsely claimed to be Mr. Jetter and made a confession to the murder, attempting to implicate Shawn Jetter in the crime. Interestingly, at the time of the call the victim was classified only as a missing person. The phone call was recorded and police investigated the call and determined that the person who made the call was definitely not Shawn Jetter. After his arrest, Mr. Jetter told his attorney about the incident, stating that there was a conspiracy to frame him. According to the attorney, the search of the police reports and the El Paso County District Attorney’s Office case file, revealed nothing about the call; no recording and no report. Since no proof of the call existed, Mr. Jetter was advised not to testify. The jury never heard the crucial evidence. After conviction, the Jetter Family reached out to Investigator Eddie Frankum of Halo Private Investigators to review the case. In 2012, Halo Investigators were able to produce evidence that is considered exculpatory “Brady Material,” (evidence that would have been favorable to Mr. Jetter’s defense but was withheld by the prosecuting agency). This New Evidence, in the form of police reports, prove a conspiracy existed against Mr. Jetter in this case (see Exhibit 1). An audio recording of the call was also made, but police refused to turn that over to investigators. Investigator Eddie Frankum then interviewed members of the jury and presented the new evidence to them. Their response was Shocking! The foreman of that jury submitted a sworn affidavit in which he acknowledged that the jury had never been made aware of the evidence outlining the conspiracy against Mr. Jetter, and that had they been made aware of this evidence he “would have without a doubt decided him to be not guilty because of reasonable doubt.” (see Exhibit 2, Affidavit) But that’s not all the investigation uncovered. While interviewing one of those jurors, investigators learned that this particular juror was a former El Paso City Police Officer, the same agency that brought the murder charge against Mr. Jetter, a matter the jury failed to mention or perhaps intentionally concealed during jury selection. Mr. Jetter presented all this evidence to the 243rd District Court in El Paso County, Texas. That court has completely ignored Mr. Jetter’s new evidence; no hearing was held, no witnesses were deposed, and no opinion as to the validity of the new evidence, even though the issues involve actual innocence and prosecutor misconduct. When the foreman of the jury found out about the court’s inaction and, even more, gave no consideration to his sworn affidavit, the Foreman sent the judge a letter wherein he states, “I am asking the Court, in the interest of justice to please take my affidavit seriously and reconsider Mr. Shawn Jetter’s recent relief efforts because were not able to consider all of the evidence related to this case.” (see Exhibit 3, Foreman’s Letter). The court continues to ignore this case. Normally, when a jury seeks to vitiate or undo its verdict due to new facts coming to light, the public, the media, and especially the courts sit up and take notice. The public wants and deserves justice and fairness. The media wants to ensure that our elected officials are carrying out their duties responsibly. And, the courts want to assure all that justice is being administered evenhandedly and fairly. So, where is the justice and fairness for Mr. Jetter? Why has the court turned its back on his legitimate grievances and refused to hear the voices of former jurors, even unto this day? Mr. Jetter only seeks what the US Constitution guarantees him; a fair trial where a jury of his peers can consider, not just some, but all the evidence in the case.
