Totally Innocent

Dear, Sir/Mam: Greetings:

Due to my current predicament I am unable to reach you and/or your office for formal consultation regarding the issues I raise herein. I write to you seeking Pro Bono representation. I am totally innocent of the crimes for which I have been incarcerated now for (21) twenty one years.

During the course of the investigation into the crimes for which I was tried by a jury, convicted and sentenced to ninety-seven (97) years, in 1988, DNA samples of the suspect's semen on the victims were recovered and analyzed. The DNA did not match me nor my co-defendant.

Fingerprints of the juvenile suspects who in the course of the commission of one of the crime attempted to steal one of the victim's vehicles were recovered thereon. None matched me nor my co-defendant. Vegetation debris evidence was collected at the crime scenes and examined and matched to my and my co-defendant's clothing which was taken as evidence as well as my vehicle interior. Non matched.

The crime for which I was arrested, tried, convicted and sentenced to ninety-seven years, was, forcible rape, robbery and assault. These crimes occurred in 1988, before the wide spread use of newly introduced DNA testing to prove guilt or innocence.

I was arrested near the scene of one of the crimes after being pulled over during the dragnet to locate and apprehend the real culprits.

My defense has always been that I did not commit the crimes that I was in the vicinity engaged in criminal activities but not that which I was eventually arrested for. I could prove that I had committed another unrelated crime while this crime was allegedly taking place. I later found out that there was four (4) juvenile arrested the same night I was arrested in which we all were convicted of the same crime.

In the intervening years I have filed several State Habeas Corpus petition seeking an evidentiary hearing and/or new DNA testing to prove my innocence to no avail. I have not been to the United States District Court on any of my claims because I have always been afraid that I would lose without proper representation and proper collection of the evidence to show my innocence, such as new DNA testing.

I am desperately asking for your assistance in helping me obtain my long deserved freedom. As an offer of initial proof in order to convince you that I am sincere, I can forward a copy of the District Attorney's Expert Witness testimony of their DNA tests results in my case. I am aware that now-a-days it is possible for lawyers to assess an online service to view a criminal court appeal of a case. Knowing this I will also forward my criminal and appellant court case number for you convenience.

If you are interested, I am willing to answer any questions as well as take a DNA test to prove my innocence.

Thank you for taking your time to read this letter. I look forward to hearing from you.

Sincerely yours,
Mario Cummings
